This study is an empirical research, searching </em><em>f</em><em>or primary data directly from its sources, and secondary data. This research aims to find out the implementation of ETLE in the juri</em><em>s</em><em>disction of Ngawi Resort Police Office. In addition, this research also compares three types of ETLE: Static, Mobile, and Handheld. Electronic Traffic Law Enforcement (ETLE) system uses electronic camera to detect and to record traffic violation. This system functions not only to take action on the violation but also to be an educating medium to improve people’s discipline and to minimize illicit roadside levies. The implementation of three types of ETLE can be compared from technical-operational perspective using three indicators: goal achievement, integration, and adaptation. These indicators were used to find out whether or not a technological system actually achieves the specified target, is coordinated well between executive unites, and is able to adapt to field condition. This is a relevant framework to distinguish effectiveness levels of Static, Mobile and Handheld ETLEs having various operational features. This study examines the legal qualification of such conduct, the criminal liability of perpetrators, and the reconstruction of criminal law policy from the perspectives of lex lata and lex ferenda. The study employs normative legal research with a prescriptive approach through statutory, conceptual, and analytical approaches. Legal materials are analyzed qualitatively through legal interpretation and juridical reasoning. The findings indicate that falsification of Letter of Acceptance may be qualified under Article 391 of Law Number 1 of 2023 concerning the Criminal Code when the statutory elements are fulfilled, while manipulation of Open Journal System may be subject to Article 35 of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions when electronic information or documents are manipulated to appear authentic. Criminal liability is determined individually based on the criminal act, fault, capacity for responsibility, and participation of each actor, including perpetrators involved in fake peer review, impersonation of editors or reviewers, journal account manipulation, and obtaining Article Processing Charge through fraudulent representations. The study concludes that lex lata provides a legal basis for prosecution but remains fragmented, requiring lex ferenda to strengthen protection of editorial integrity, professional identities, digital audit trails, and electronic evidence.</em></p> Hana Hanifia Yusrima Latifa Hanum, Muchamad Ikhsan Hak Cipta (c) 2026 https://www.journal.uniba.ac.id/index.php/SH/article/view/1672 Fri, 02 Oct 2026 00:00:00 +0700 Patroli Laut Bea dan Cukai di Kabupaten Cilacap Sebagai Instrumen Pengawasan Negara https://www.journal.uniba.ac.id/index.php/SH/article/view/1674 <p><em>As an archipelagic nation, Indonesia faces challenges in monitoring the movement of goods in its territorial waters, particularly regarding the risk of smuggling, which can harm government revenue and domestic industries. The Directorate General of Customs and Excise (DJBC) has the authority to conduct maritime patrols as a tool for customs and excise oversight. Cilacap Regency is a strategic yet vulnerable area because it borders the Indian Ocean and the Indonesian Archipelagic Sea Lanes (ALKI). This study aims to describe the implementation of Customs and Excise maritime patrols in the waters of Cilacap and to identify the obstacles encountered. The study employed a qualitative descriptive method through interviews, literature review, document analysis, and documentation of vehicle inspections. The results indicate that patrols are conducted through intelligence-based planning, administrative and logistical preparation, routine and ad hoc patrols, the stopping and inspection of vehicles, as well as reporting and evaluation. Operations are carried out independently using the BC 10019 speedboat or in a joint effort with the Indonesian Navy (TNI AL), the Marine Police (Polairud), the Indonesian Coast Guard (Bakamla), and the Directorate General of Marine Resources and Fisheries (PSDKP). Major challenges include limitations in the fleet, budget, personnel, navigation and communication equipment, as well as the practice of disabling AIS and changes in smuggling methods.
